Introduction

Data Privacy is important to Voyon Technology Services Pvt LTD. (hereafter referred as Voyon) which includes Voyon, and its partners. This Privacy Statement describes the information we collect about you as a visitor to www.voyon.net and www.voyonfolks.com or other Voyon websites that link to this Privacy Statement, how Voyon will use the information provided, and with whom we may share the information. The Statement describes your choices and rights related to the information that is provided to or collected by Voyon. This Privacy Policy also explains the choices you have in relation to these processing activities. If you are a user of the Voyon products, your use of Voyon services is governed by your organization’s policies. Please direct your privacy questions or concerns to your employer or your organization’s Voyon administrators. As used in this Privacy Policy, ‘personal information’ or ‘personal data’ means information that relates to an identified individual or to an identifiable individual. For example, this could include among other things your name, address, email address, business contact details, or information gathered through your interactions with us via our websites or at events. Personal information is also referred to as ‘information about you.’


Scope

This Privacy Policy applies to the processing of personal information by Voyon of:

  • visitors and users of the various Voyon sites, including our websites www.voyon.net and www.voyonfolks.com, our social media pages that link to this Privacy Policy (collectively referred to as the sites);
  • customers and prospective customers and their representatives.
  • subscribers to Voyon product updates
  • business partners and their representatives


Type of Information we process and sources

Voyon can process information about you collected both offline and online.

Offline Information about you originates from our interaction with you during in-person meeting or Voyon events, workshop, conferences etc.

Online Information about you originates from your activities on our sites for example subscription, your interaction with Voyon via email, telephone etc. Information about you may also be provided by third party sources, such as data aggregators who may not have a relationship with you.

Information about you that we may collect, and process includes:

  • Name and physical address, email addresses, and telephone numbers.
  • Photographs and testimonials.
  • Transactional data, including products and services ordered, financial details and payment methods.
  • Company data such as the name, size and location of the company you work for and your role within the company.
  • Unique IDs such as your mobile device identifier or cookie ID on your browser.
  • IP address and information that may be derived from IP address, such as geographic location.
  • Information about a device you use, such as browser, device type, operating system, the presence or use of “apps", screen resolution, and the preferred language.


How do we use your personal information
  • To communicate and respond to your requests and inquiries to Voyon

If you get in touch with us (such as by submitting contact forms on our sites, attending Voyon events or other occasions, sending an email or by visiting social media platforms), we process information about you to communicate with you and to respond to your requests or other inquiries. We can also process personal information to interact with you on third party social network

  • To administer subscriptions of Voyon mailing list

If you subscribe to our updates, we process information about you to administer your subscription (including the renewal process).

  • To market our products and services or related products and services and to tailor marketing and sales activities

Voyon may use information about you to notify you about new product releases and service developments, events, alerts, updates, prices, terms, special offers and associated campaigns and promotions (including via newsletters). Voyon may also use personal information to advertise its products and services or related products and services, and also to have our distributors, dealers or other partners notify you about our products or services or their related products or services (such as via joint sales or product promotions).

If you attend an event, Voyon may process information about you gathered in relation to the event and can share information about your attendance with your company.

  • To engage in transactions with customers, suppliers and business partners and to process purchases of our products and services

If you place an order for our products and services, or if you provide services to Voyon, our employees, customers or partners as a supplier or business partner, Voyon processes information about you to engage in and administer the relevant transactions (such as by sending invoices and making payments), administer your order, and help you get started and adopt our products and services.

  • To analyze, develop, improve, and optimize the use, function and performance of our sites and products and services

We may process personal information to analyze, develop, improve and optimize the use, function and performance of our sites and products and services, as well as marketing and sales campaigns. In case the sites permit you to participate in interactive discussions, create a profile, post comments, opportunities or other content, or communicate directly with another user or otherwise engage in networking activities, Voyon may process personal information when moderating these activities.

  • To manage the security of our sites, networks, and systems

We may collect site use data for security and operations management to help keep our sites, networks, and systems secure, or to investigate and prevent potential fraud, including ad fraud and cyber-attacks and to detect bots.

  • To comply with applicable laws and regulations and to operate our business

In some cases, we must process personal information to comply with applicable laws and regulations. For example, to respond to a request from a regulator or to defend a legal claim. We may also process personal information in the performance and operation of our business, such as to conduct internal audits and investigations or for finance and accounting and archiving and insurance purposes.


Retention of Personal Information

Voyon maintains personal information for the following retention periods:

  • Information about you we collect to engage in transactions with our customers, suppliers and business partners, and to process purchases of our products and services, will be retained for the duration of the transaction or services period, or longer as necessary for record retention and legal compliance purposes.
  • If you have registered for a Voyon account, your account information will be retained for as long as you maintain an active account. Your account and account information will be deleted if you do not log in for 3 consecutive months. Voyon retains records of that deletion for maximum 90 days
  • If you have registered for our newsletters and blogs your subscription data will be retained for as long as you are subscribed to our distribution lists.
  • Contact information such as your email address or phone number collected online on our sites or offline from our interactions with you at Voyon events and conferences, and used for direct marketing and sales activities will be retained for as long as we have an active (customer) relationship with you.
  • If you have reached out to us via Voyon chat, we will delete all chat transcripts post mitigation of our business purpose.

Disclosure

Voyon may share information with Voyon partners, and third-party service providers or vendors contracted to provide services on our behalf. These third-party service providers or vendors may use information we provide to them only as instructed by Voyon.

Voyon may offer the following solely or jointly with third parties or partners: webinars, events, whitepaper downloads, or other services related to Voyon products or services. We may share your contact information and interests in these products or services with these approved third parties to communicate with you about Voyon.

When you attend an event (either sponsored by Voyon or one where Voyon is a participating vendor) and have your badge scanned, your information will be shared with Voyon, as well as with any partner or third party participating in that event, and potentially with the entity sponsoring your attendance at the event. For example, if your badge is scanned as you attend a session at a Voyon sponsored conference, Voyon and any co-presenters will have access to that information to understand who was in attendance, and potentially follow up with you on relevant products or services. If you do not want your information shared with Voyon or partners in this manner, do not have your badge scanned. If your badged is scanned by a partner or a third party at an event, your information will be governed by that party’s privacy statement.

Voyon may disclose information if we have a good faith belief that such action is necessary to (a) conform to legal requirements or comply with legal processes; (b) protect and defend our rights or property; (c) enforce the website Terms and Conditions; and/or (d) act to protect the interests of our users or others.

If Voyon goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal information may be among the assets transferred.


Do Not Track

Without a common industry or legal standard for interpreting Do Not Track (DNT) signals, Voyon does not respond to browser DNT signals. We will continue to monitor further development of a DNT standard by the privacy community and industry.


Global Privacy Consideration

Personal information collected by Voyon may be stored and processed in the India or in any other country where Voyon or its affiliates, subsidiaries, or third-party service providers maintain facilities. When you provide personal information to Voyon, you consent to the processing and transfer of your information within the India and around the world. We follow applicable data protection laws when transferring personal information.


APEC Program Statement

Voyon privacy practices, described in this Privacy Statement, comply with the Asia-Pacific Economic Cooperation (“APEC”) Cross-Border Privacy Rules (“CBPR”) System. The APEC CBPR system provides a framework for organizations to ensure protection of personal information transferred among participating APEC economies.


Security

Voyon has implemented appropriate technical, physical, and organizational measures designed to protect personal information against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorized disclosure, or access, as well as all other forms of unlawful processing.


Cookies

Cookies are small text files that contain a string of characters and uniquely identify a browser on a device connected to the Internet. Any browser visiting our sites will receive cookies from us. We use cookies and other technologies on all our sites to ensure the best possible and secure experience on our sites and to provide you with tailored information on products and services. Voyon also uses cookies or similar technologies on its sites to collect online information such as your mobile device ID, IP address, and other information about your device, as well as behavioral data of your device usage on our sites (e.g. pages viewed, links clicked, documents downloaded).
If you do not want to receive cookies, you can also change your browser settings on your computer or other device you are using to access our services. Most browsers also provide functionality that lets you review and erase cookies.


Location Information

We collect and use precise location information from your device with your permission when you choose to use location related features, like when you mark the attendance or use the Route Map feature. This information is collected from both Voyon Folks web application and Voyon Folks mobile application.


  • Data Storage

    The Licensee hereby acknowledges that the Licensor stores the data relating to the Licensor and its clients (including the Licensee) on a cloud storage platform called “Microsoft Azure: cloud computing service” (“Cloud Partner”). The Licensor will be responsible for its own information technology as well infrastructure, but the other terms and conditions as regards the cloud storage platform will be governed by the Cloud Partner. As regards data protection, the terms and conditions available with Microsoft Azure cloud computing service will be applicable.

  • Data Retention

    Voyon will store the data till the agreement with the client is active. Upon termination of the agreement Voyon will retain such data and information which is mandatory to be retained for audit purpose as per applicable law, rest all data will be given back to the client.

  • Intellectual Property

    Intellectual property and all other proprietary rights will have the broadest possible meaning for the purpose of this Agreement and include, without limitation, all patent rights, copyrights, trademarks, rights relating to the protection of trade secrets and confidential information, and any right similar to any of the foregoing.
    The title and related rights in the content accessed through the Software is the sole property of the Voyon. The title, ownership rights, and intellectual property rights in Software, including any modifications, improvements, updates, versions, etc. thereof is and shall remain solely vested with the Voyon. Client acknowledges such ownership and intellectual property rights and agrees that it will not take any action to jeopardize, limit or interfere in any manner with Licensor’s ownership of or rights with respect to Software.
    Client shall not use or allow any employee, agent or third party to use or exploit the Voyon’s trademarks or copyright or patent or design or any other intellectual property rights (including marketing material) without the prior written permission of the Voyon.
    No rights in or to the Services or Software installed are hereby granted or intended to be granted to the Client, except the limited right to use and access the Software as agreed to between the Parties.
    Subject to the rights expressly granted to the Client under this Agreement, Client shall not be entitled to make or cause to be made any additions, alterations, modifications, analyses, comments, observations, abstracts or extracts of, or copy, reproduce, in any manner whatsoever, to the Software provided under this Agreement. Client shall indemnify Licensor and Licensor’s employees, officers and agents against any loss suffered by all or any of them, in the event of a breach of this Section.

  • Equitable Remedies

    Without prejudice to any other rights or remedies that any Party may have, the client (for itself and on behalf of its Related Persons) acknowledges and agrees that damages alone would not be an adequate remedy for any breach of the provisions of this Agreement. The Client acknowledges without proof of actual damages that injunctive relief, specific performance or other equitable relief as may be deemed proper by a court of competent jurisdiction in favor of Voyon is an appropriate and necessary remedy for breach of the terms of this Agreement.
    The Client agrees, to indemnify Voyon and its Related Persons for any costs, claims, demands, liabilities and expenses of whatever nature that such member may incur arising directly or indirectly out of a breach of the Client’s or Related Party’s obligations under this Agreement.

Changes to this privacy statement

We reserve the right to change or update this Privacy Statement at any time. Changes to the Privacy Statement will be posted on this website and links to the Privacy Statement will indicate that the statement has been changed or updated. We encourage you to periodically review this Privacy Statement for any changes. For new users, changes or updates are effective upon posting. For existing users, changes or updates are effective 30 days after posting.
